Bolivar County Jury Verdict for OB/GYN

On February 14, 2020, Tommie Williams and J.L. Wilson obtained a jury verdict in favor of an OB/GYN in Bolivar County, Mississippi. The Plaintiff contended that the GYN surgeon perforated the patient’s bowel, failed to inspect the bowel and failed to discover the injury prior to concluding the surgery. The defense countered that the small bowel was not perforated during the surgery. Through a combined attack of the testimony of the general surgeon who repaired the injury, presenting medical records from different facilities and testimony of the defendant and gynecological surgery expert, the defense showed that the plaintiff suffered an undiagnosable injury to the bowel, that the defendant physician carefully inspected the bowel prior to ending the procedure and that the injury did not manifest until several days after the surgery. The case was tried for 5 days in Cleveland, Mississippi. After deliberations, the jury returned a verdict in favor of the physician. No appeal was taken and the jury’s verdict is final.
