Hinds County Summary Judgment In Electric Shock Case

On February 5, 2018, Hugh Gillon obtained a summary judgment in Hinds County dismissing claims against a premises owner per Mississippi Code Annotated § 11-1-66.  The Plaintiff was an employee of an independent contractor who received electric shock injuries when the ladder he was holding came into contact with overhead power lines.  He claimed that the premises owner was negligent for failing to provide a safe workplace and failing to warn of dangers on the premises.  Finding that the Plaintiff knew or reasonably should have known of the dangerous conditions posed by the presence of the subject power lines, the court applied Mississippi Code Annotated § 11-1-66 and granted summary judgment for the premises owner.
